BREAKING: Court squash suits seeking Magu’s removal as EFCC ag. chairman
The Federal High Court in Abuja has stoke out suits looking for the removing of Mr. Ibrahim Magu as the Acting Chairman of the Economic and Financial Crimes Commission on Wednesday.
According to reports, the suit seeks Magu’s removal on the grounds that the Senate had twice rejected his appointment and refused to screen him to take up the place in a substantive capability.
The plaintiff argued that Magu, who has been appearing as the EFCC chairman since 2015, having been rejected by the senate, was not fit to proceed to serve in that capacity, Punch reports.
Delivering judgment, Justice Ijeoma Ojukwu held that there was a lacuna within the legislation by not offering for the timeframe inside which an individual might act as EFCC’s chairman.
She further said that though the lacuna ought to not be exploited to “set up” Magu in workplace in substantive capability with out the Senate affirmation, it had given the President as the appointor “the proverbial yam and the knife to do as he pleases” with the appointment of the EFCC chairman.
